# Analysis of professional imprudence and reckless imprudence in a new webinar “Meetings with the Mutual Fund”

Fraternidad‑Muprespa held a new edition of the cycle this ThursdayMeetings with the Mutualwith a webinar dedicated entirely to the analysis of professional imprudence and reckless imprudence, two key concepts to understand the limits of the work accident and its correct legal classification.

The session was opened by Silvia Vela, director of the Department of Communication and Institutional Relations, who introduced the topic of the webinar and introduced the speaker,Alejandra Vivancos, lawyer at the Mutua Legal Services and Advisory Center. Graduated in Law from the Autonomous University of Madrid and Master's Degree in Access to the Legal Profession from the Francisco de Vitoria University, she has professional experience in the field of Social Security. After practicing in various offices, he joined Mutua in 2022, where he mainly addresses judicial procedures related to Social Security benefits.



 

Vivancos addressed the regulatory framework of article 156 of the General Social Security Law and its interpretation by the most recent jurisprudence.

During the session, it was recalled that the Spanish legal system adopts a markedly protective criterion, which requires interpreting the causes of exclusion, including reckless imprudence, in a very restrictive manner. He also explained that not every violation or carelessness constitutes reckless imprudence, since this requires a conscious disregard of the risk, a voluntary assumption of a serious danger and the absence of any objective justification.

### What the jurisprudence includes 

Through the analysis of various Supreme Court rulings, the speaker illustrated how jurisprudence has delimited both concepts. He explained it through cases in which the High Court appreciated such reckless imprudence, such as jumping a red light or crossing an expressway at night at a non-authorized point, compared to others in which it was considered professional imprudence, linked to routine, overconfidence or the automatisms of work.

Likewise, recent resolutions were addressed in which reckless imprudence is not linked to a crime related to traffic or driving, but is also seen in other contexts, such as the disregard of medical indications in the face of serious symptoms, highlighting that the key always lies in the awareness of the risk and the voluntariness of assuming it.

The webinar concluded with a space for questions in which prevention professionals, human resources and legal advice were able to raise doubts and practical cases.
