# DRAFT MUTUAL LAW AND RD 625/2014 OF JULY 18

Regulations

Last Friday, July 18, the Council of Ministers approved a Bill which modifies the consolidated text of the General Social Security Law that regulates the legal nature of mutual societies, their economic regime and aspects related to their governance, as well as their responsibilities and functions. The Project will continue the parliamentary process for approval by the Cortes.

The highlights of the Bill are:

* The legal nature and operation of mutual societies are defined, which will be called Social Security Mutual Collaborators.
* The public legal regime is established for the benefits they manage, as well as the resources they have available.
* The internal structure of mutual societies is regularized, especially the figure of the President; The remuneration of the management staff and the functions of the Manager are defined. As well as the participation of social agents in the participation bodies of the Mutual Insurance Companies, fundamentally in relation to their presence in the Control and Monitoring Commission.
* New definition of the destination and percentage of the Mutual Funds' reserves, as well as the surpluses.
* The procedures for accessing the cessation of activity benefit for self-employed workers are simplified.
 
Likewise, it was approved RD 625/2014 of July 18, which regulates certain aspects of the management and control of the processes for Temporary Disability in the first three hundred and sixty-five days of duration, which will come into force next September 1. Establishing a transitional regime of 6 months for the response deadlines of the SPS and the INSS.  
   
The highlights are:

* Mutual insurance companies are authorized to carry out the management and control of these processes from the first day of sick leave (until now control began on the 16th day of medical sick leave).
* The procedure for ITCC registration proposals made by Mutual Insurance Companies is regulated:
a) The mutual insurance companies may make a proposal to register for the SPS medical inspections, which will have 5 business days to respond to both the INSS and the mutual insurance companies.  
 b) If there is no response or it is negative, the Mutual Fund may send said registration proposal to the INSS, which will have a period of 4 days to respond to it.A transitional regime is established of 6 months (until March 1, 2015) during which the response periods of the SPS (extended up to 11 days) and the INSS (extended up to 8 days) are extended.

 
* The periods and delivery of the confirmation reports are specified, which will be delivered based on the estimated duration of the process, establishing the following deadlines:
 
a) For those processes of up to 5 days of cancellation, cancellation and registration will be delivered at the same time.  
 b) For processes estimated to last between 5 and 30 days, a confirmation part will be delivered every 14 days.  
 c) For processes that last between 31 and 60 days, every 28 days.  
 d) For processes with an estimated duration of more than 60 days, a confirmation part will be delivered every 35 days.

 
* The probable duration of the process will be incorporated into the discharge, depending on the diagnosis.
* The aim is to improve the communication of cancellations so that it is a daily process of communicating new cancellations from the SPS to the INSS and from this to the Mutual Insurance Companies.
* In the event of non-appearance at the Mutuas' medical examinations (to which workers must be summoned at least 4 business days in advance): the subsidy will be provisionally suspended and the worker will be given a period of 10 business days, counting from the day of non-appearance, to justify it. If it is justified within the period in the terms provided in the RD, the precautionary suspension will be annulled, otherwise, the termination of the financial benefit will be agreed.
* Several provisions are established that modify aspects related to workers' claims, contingency determinations, reviews/challenges of medical discharges, as well as aspects related to benefits for risk of pregnancy and breastfeeding and aspects of collaboration between mutual insurance companies and public health administrations.
