# The human and legal impact of the fatal work accident, analyzed in a new “Meetings with the Mutua”

Meetings with the mutual

Fraternidad-Muprespa resumed this Thursday its “Meetings with the Mutual” webinar, a technical and practical space of specialized sessions taught by professionals from the entity and focused on delving into regulatory aspects linked to topics of interest that are part of the daily life of companies and consultancies.

On this occasion, the focus of the day was very sensitive: “Work accident resulting in death and protective action by the Mutual Fund.” The session was presented by Silvia Vela, director of the Department of Communication and Institutional Relations of the Mutua, who gave way to the speaker,Alejandra Alonso de Castañeda, head of the professional contingency area of the Department of Economic Benefits, where she ended up ten years ago after working as a lawyer specialized in Labor and Social Security Law.

Employer obligations and activation of the procedure

Alonso de Castañeda began his speech before the nearly 400 people in attendance by highlighting the exceptional seriousness of the issue: “"We are going to address the worst work accident that we can suffer or that we can encounter, which is the one that ends with the death of the worker.", highlighting that a fatal accident, in addition to the irreparable loss of a life, triggers a set of legal and economic effects, and activates the protective action of the Social Security system.

The speaker recalled that, in the event of a fatal workplace accident, the employer must communicate the fact to the provincial labor authority within a maximum period of 24 calendar hours, a communication that does not condition the subsequent classification of the accident: “rWe recommend communicating even if there is doubt. This communication does not mean that we are presupposing that it is a work accident.”

After receiving the report, the mutual insurance company opens a file for death and survival benefits and activates a two-phase procedure, the classification of the accident and the analysis of the benefits requested by the family, which may be: assistance for death, widowhood, orphanhood, temporary subsidy and special flat-rate compensation.

Benefits, support and recent jurisprudence

He stressed the importance of support at a particularly delicate moment in which families are overwhelmed. ”We intervene to help collect documentation and accompany the process”, he pointed out.

He also explained the difference between the pension and special compensation: “The special lump-sum compensation is paid directly by the Mutual Funds and is received very quickly. The pension involves another procedure and is paid by the INSS, although with retroactive effects.”

A section of the webinar was also dedicated to explaining recent Supreme Court jurisprudence on requirements to access the widow's pension when there is no marriage bond. He recalled that the law requires three simultaneous requirements: being united as a de facto couple at the time of death, not having formed another previous union and proving registration in an official registry with at least two years of experience, in addition to a minimum cohabitation of five years.

He cited ruling 120/2024, of January 25, on a woman recognized as a victim of gender violence, 158/2026, of February 11, on another woman, also a victim of gender violence, who asked to be exempt from the requirement of registration in the registry of de facto couples, and a third especially striking case: a couple who lived together for more than twenty years and had authorization to marry before a notary three days before the declaration of the state of alarm due to the pandemic. The wedding could not be celebrated and one of the members died during confinement. In this case, the Supreme Court did apply an exceptional dispensation, considering that the impossibility of formalizing the union was a direct consequence of an extraordinary situation.

The session, which ended with the speaker's answers to several questions posed by several attendees, allowed companies and professionals to learn in detail the procedures, obligations and protection mechanisms that are activated in a fatal work accident, as well as the powers of the mutual insurance company in the management of these benefits.

Silvia Vela closed the meeting by thanking the attendees for their presence and inviting the next webinar, which will take place on October 8.
