Conference of the College of Social Graduates of Alicante on the review of medical discharge

Fraternidad-Muprespa participated on Wednesday, March 29, in the online conference on medical discharge review and contingency determination organized by the College of Social Graduates of Alicante.

Maria Antonia Oliva Verdú, president of the College, greeted the attendees who were participating, thanked the Mutua for its participation in this type of training actions and introduced Ana Lorenzo Cárdenes, coordinator of the Economic Benefits department. In the first part of her intervention, Ana Lorenzo analyzed the Temporary Disability procedure and its elements, such as the applicable regulations and the recent legal changes of Royal Decree Law 2/23 of March 16, and the particularities of the same, also the official nature and automaticity in the general regime, or the jurisprudence generated by the Supreme Court regarding the duration of payment or retroactivity, among other issues discussed. It also analyzed the procedure for challenging the medical discharge issued by the Mutual Fund in the professional contingency, both for cure and improvement, and all the constituent elements of the medical discharge review file: who promotes it, before whom and how it should be done. He also referred to the procedure for disagreement with the medical discharge issued by the Managing Entities, as well as the judicial process and all the relevant elements included in the Regulatory Law of Social Jurisdiction. In the second part of her intervention, Ana Lorenzo analyzed the contingency determination procedure and its fundamental aspects.

After the presentation, the question time began with Eloy Ávila Lacalle, Provincial Director of the Mutua in Alicante, who closed the day by thanking all attendees for their participation.
