Mar Alarcon has been the protagonist of a conference organized by
Silvia Vela, director of the Department of Communication and Relationses Institutional of Fraternidad-Muprespa, fwho was in charge of welcoming the webinar and gave way to Sonia Medrano, Southern Territorial Director of the Mutua, who put the central theme of the day in context.
The professor of Labor and Social Security Law at the Rey Juan Carlos University of Madrid first explained the regulatory and judicial context that went from automatic extinction to inclusion, as well as the key international mandates that affect this labor reality, the constitutional and statutory framework and the complementary legislation in this regard, to then go on to describe the objectives of Law 2/2025.
As he explained, "before any termination decision due to disability, the employee's job continuity must be attempted through adjustments to his or her job or transfer to another compatible position, which implies a significant responsibility for the company if it is not fulfilled or fulfilled incorrectly. Dismissing due to absenteeism linked to a disability is indirect discrimination."
Alarcón also made an exhaustive review of the employer's obligations following a declaration of permanent disability, as well as a summary of the deadlines that affect the procedure and the motivations that may lead to one solution or another, as well as the particularities related to each process, for example, depending on the size of the company.
In her presentation, the former General Director of Labor of the Community of Madrid reviewed some common situations in the process for the relocation of a worker, for example that their remuneration or their level or professional category may vary, as well as the role that medical and occupational risk prevention services have.
Finally, he presented several specific examples and the cases applicable to each of them, which gave way to an interesting debate and a round of questions to which the speaker answered.
