AN INFORMATION DAY ON THE ASPECTS OF SOCIAL SECURITY AND OCCUPATIONAL RISK PREVENTION IN THE NEW SOCIAL JURISDICTION LAW HAS BEEN HELD IN MADRID

Last November 23rd it was celebrated at the hospital by Fraternidad-Muprespa(Paseo de La Habana 83-85, Madrid) an informative day on the recent Law 36/2011, of October 10, regulating social jurisdiction.

To explain its content, objective, impact and impact, there was a large group of experts in the field. The first part of the day was led by Professor Carlos Alfonso Mellado, professor of Law. of Labor, U.de Valencia, who focused his conference on a broad explanation of the main aspects that are affected by Law 36/2011, with special attention to what he considers the fundamental objectives: The powers, the General Rules and the Specific Rules.

The essential element that defines and characterizes this Law is the “Prevalence of the normative nature”, covering all legal and conventional obligations that arise regarding the prevention of occupational risks in all areas and for all actors.

According to the professor, the “elimination of Jurisdictions but not of Bodies” is another key element that modifies the Law. It unifies in the Social Jurisdictional Order the knowledge and processing of all contentious issues related to work accidents and occupational diseases.

The round table was also held “The application of the Law of Social Jurisdiction in Matters of Social Security and Prevention of Occupational Risks”, composed of Mr. José Manuel Martín Martín, Managing Partner of Sagardoy Abogados; Mr. Juan Miguel Torres Andrés, Magistrate, President of the Social Chamber of the Superior Court of Justice of Madrid; Mr. Juan Sebastián Fdez.-Simal, Labor and SS Inspector, Occupational Health and Safety Unit, Management Group for the prevention of occupational risks; and Enrique Lillo, Director of the Interfederal Legal Office of CC.OO.  Although there were many aspects that were debated, the burden of proof represented a crucial axis among those attending, including among the participation of mutual members and associates who attended the event.
