Royal Decree-Law 7/2023, of December 19, adopting urgent measures to complete the transposition of Directive (EU) 2019/1158, of the European Parliament and of the Council, of June 20, 2019, on the reconciliation of family and professional life of parents and caregivers, and repealing Council Directive 2010/18/EU, and for the simplification and improvement of the level of unemployment protection assistance.
The following aspects are notable from this standard:
- Article first. One-HE modifies article 37.4 of the Workers' Statute, so that the accumulation of breastfeeding leave It is no longer conditional on what is foreseen in collective bargaining nor to an agreement with the company. This measure enters effective tomorrow, December 21.
- Article first. Two -. HE modify sections 3 and 4 of article 84 of the Workers' Statute. The application priority of the agreements or regional collective agreements over those at the state level, provided that have the support of the majorities required to constitute the negotiating commission and sign agreements of a statutory nature in the corresponding bargaining unit and their regulation is more favorable for workers than that established in state agreements or agreements.. - Second article-. In matters of unemployment assistance modifies the General Law of Social Security. Almost all of l the measures will enter effective June 1, 2024, with few exceptions.
Additionally, there are modifications to the Law on Infringements and Sanctions of the Social Order, as well as in the Royal Decree 625/1985, of April 2, which develops Law 31/1984, of August 2, on Unemployment Protection to adapt it to the new regulations.
