Expansion of preventive activities to be applied by Mutual Insurance Companies

The Official State Gazette today, September 29, publishes the Resolution September 25, 2020, which expands, as a consequence of the health crisis situation caused by COVID-19, the preventive activities of Social Security provided for in the Resolution of March 28, 2019, which establishes the General Plan of preventive activities to be applied by the Mutual Companies collaborating with Social Security in the planning of their activities for the year 2019.

The text modifies the first section of the Resolution of March 28, 2019 in the following terms:

A new section is added to paragraph 1, relating to the technical advice program for SMEs and companies in preferred sectors, with the following wording:

«d) In companies with less than 50 workers, advisory actions will be carried out to promote the implementation of preventive measures established by the Ministry of Health for the maintenance or reincorporation of the activity of companies and their workers due to the health crisis caused by COVID-19, preferably in those belonging to those sectors that return to activity with important modifications to their work procedures (such as hospitality, commerce, etc.) and to sectors with special exposure to the virus (such as health and care). This activity can be carried out, when possible, through telematic means or other means of communication, without, where appropriate, in-person assistance being necessary. "

A new subsection is added at the end of paragraph 2, relating to the advisory program for companies or concurrent activities with the following wording:

«Likewise, advice will be given to those companies that, due to their characteristics, particularities, provision of services or reception thereof, may contribute to increasing the risk of contagion by COVID-19».

A new heading is added relating to research, development and innovation activities for the reduction of professional contingencies with the following wording:

«j) Activities on the different actions established by the Ministry of Health for the maintenance and safe reintegration of workers into the company, as well as measures and actions to be carried out subsequently, due to COVID-19, which will include the implementation of the following actions:

1. Linked to article 2.2.c).

Design of big data analysis, through AMAT and after signing the appropriate data transfer agreement, in confirmed cases of SARS-CoV2 in risk sectors of the healthcare field whose occurrence could, where appropriate, be classified as an occupational disease, as well as in cases of work accidents, in the cases considered in article 9 of Royal Decree-Law 19/2020, of May 26. 

Development of innovative integrated management systems for companies safe from COVID-19 contagion.

2. Linked to article 2.2.c)3 of Royal Decree 860/2018, regarding the development of procedures for analyzing potential risks to the health of workers linked to teleworking activities, digital commerce, small distribution, etc., in general that address the risks of a society that by necessity is going to be more digital.Innovation in methodological developments for the design of business contingency plans regarding preventive needs, anticipating alert situations.

Development of innovative collective protection procedures and tools that reduce the risk of contagion in companies.

Preparation, dissemination of codes of good practices and carrying out informative activities on the different actions established by the Ministry of Health.

Other aspects that the Resolution includes are related to the presentation by the Mutual Insurance Companies of the expansion of the plan of preventive activities to be developed in 2020 as well as the information on the execution of said plan.
