Surely we have often heard about the work of the Labor Inspection to guarantee that the legal requirements related to workplace safety are met or perhaps we have read or heard some news in which the prosecutor requests a certain penalty to clarify responsibilities due to a work accident.
Both figures, the Labor Inspection and the Public Prosecutor's Office, are part of the occupational risk prevention system of our country and are essential as legal support to achieve safe working conditions for workers, demanding compliance with the prevention law 31/1995 and the rest of the existing regulatory development behind occupational safety.
How far does the criminal liability of the employer or prevention technician go in the event of a work accident? Is it necessary to have everything documented and justified to avoid sanctions? What are the most common reasons for sanctions for the Labor Inspection?
