How the law guaranteeing sexual freedom affects prevention

Last September, Organic Law 10/2022 of September 6, comprehensively guaranteeing sexual freedom, was published in the BOE, the entry into force of which will take place on October 7.

This regulation is relevant in our field given that article 12 is dedicated toprevention and awareness in the workplace and details the following points that affect companies:

  • Companies must include sexual violence among the concurrent occupational risks in the risk assessment of the different jobs occupied by female workers, and must train and inform their female workers about it.
  • They must promote working conditions that prevent the commission of crimes and other conduct against sexual freedom and moral integrity at work, especially focusing on sexual harassment and harassment based on sex. Likewise, they must arbitrate specific procedures for its prevention and to channel complaints or claims that may be made by those who have been victims of these behaviors, including specifically those suffered in the digital sphere.
  • Companies may establish measures that must be negotiated with the representatives of workers, such as the development and dissemination of codes of good practices, the implementation of information campaigns, action protocols or training actions.
  • They will also promote awareness and offer training for comprehensive protection against sexual violence to all personnel at their service and those that adapt their structure and operating standards to what is established in this organic law will be recognized with the distinction of "Companies for a society free of gender violence."
