Law on urgent prevention, containment and coordination measures against Covid
The maintenance of the current crisis situation derived from the Covid pandemic recommends the immediate modification of those precepts provided for in the legislation in force in order to guarantee greater effectiveness and coordination in the adoption of measures to confront them, and for this reason this regulation has been published, with the aim of achieving this effectiveness in its response.
The measures that stand out at the level of prevention of the risk of contagion in the workplace are included in chapter II made up of articles 6 to 16 that detail the maintenance of certain prevention and hygiene measures in different areas and the mandatory use of masks.
We would like to especially highlight what is included in article 7 regarding the measures aimed at adopting in workplaces.
Article 7. Work centers.
1. Without prejudice to compliance with the regulations on the prevention of occupational risks and the rest of the applicable labor regulations, the owner of the economic activity or, where applicable, the director of the centers and entities, must:
a) Adopt ventilation, cleaning and disinfection measures appropriate to the characteristics and intensity of use of the work centers, in accordance with the protocols established in each case.
b) Make water and soap, or hydroalcoholic gels or disinfectants with virucidal activity, authorized and registered by the Ministry of Health, available to workers for hand cleaning.
c) Adapt working conditions, including the arrangement of workstations and the organization of shifts, as well as the use of common places in such a way as to guarantee the maintenance of a minimum interpersonal safety distance of 1.5 meters between workers. When this is not possible, workers must be provided with protective equipment appropriate to the level of risk.
d) Adopt measures to avoid the massive coincidence of people, both workers and clients or users, in the work centers during the time slots of expected greatest influx.
e) Adopt measures for the progressive return to work in person and the promotion of the use of teleworking when it is possible due to the nature of the work activity.
2. People who present symptoms compatible with Covid-19, or who are in home isolation due to a diagnosis or who are in a period of home quarantine due to having had close contact with a person with the disease, should not go to their workplace.
3. If a worker begins to have symptoms compatible with the disease, they will immediately contact the telephone number enabled for this by the corresponding autonomous community or health center, and, where appropriate, the corresponding occupational risk prevention services. Immediately, the worker will put on a mask and follow the recommendations indicated, until his or her medical situation is assessed by a health professional.
