Legislative news related to Covid for health professionals

The Official State Gazette has published on February 3 the Royal Decree-Law 3/2021, of February 2, by which measures are adopted to reduce the gender gap and other matters in the fields of Social Security and economics.

Its sixth article includes the benefits caused by professionals from health and socio-health centers who, during the provision of health or socio-health services, have contracted the SARS-CoV-2 virus in the exercise of their profession.

The personnel who provide services in health and social-health centers registered in the corresponding registries who, in the exercise of their profession, during the provision of health or social-health services, have contracted the SARS-CoV-2 virus, within the period from the declaration of the international pandemic by the World Health Organization until the lifting by the health authorities of all the prevention measures adopted to address the health crisis caused by the aforementioned virus. SARS-CoV-2 will have the same benefits that the Social Security system grants to people who are affected by an occupational disease.

The occupational risk prevention services must issue the corresponding report stating that in the exercise of their profession they have been exposed to the SARS-CoV-2 virus due to the provision of health or socio-health services.

Once the contagion of the virus has been proven in the time frame established above and the report provided for in the previous paragraph has been provided, it will be presumed, in any case, that the contagion has occurred in the exercise of their profession in the provision of health or socio-health services. Subsequently, the entity responsible for said benefits will be the one that covered the professional contingencies at the time of the medical leave due to contagion of the disease.
