Modifications to the Occupational Risk Prevention Law

Last Thursday, the Royal Decree-Law 16/2022, of September 6, was published in the Official State Gazette, for the improvement of the working conditions and Social Security of home workers, which contains two modifications to the Law 31/1995, of 8 November of occupational risk prevention.

First of all, section 4 of article 3 is deleted, the wording of which was: "this Law will not apply to the special employment relationship of the family home service. Notwithstanding the above, the owner of the family home is obliged to ensure that the work of its employees is carried out under proper conditions of safety and hygiene."

As a consequence of the above, an eighteenth additional provision is added that will be dedicated to the protection of safety and health at work of workers in the field of the special employment relationship of the family home service. In the field of the special employment relationship of family home service, workers have the right to effective protection in matters of safety and health at work, especially in the field of prevention of violence against women, taking into account the specific characteristics of domestic work, in the terms and with the guarantees provided for by regulation in order to ensure their health and safety.

The fifth additional provision of Law 31/95 dedicated to the operation, organization, composition and budget of the State Foundation for the Prevention of Occupational Risks is also modified, which has the purpose of promoting health and safety conditions at work, especially in small businesses, through the management and promotion of information actions, technical assistance, training and promoting compliance with regulations.
