Prevention and Data Protection
Today, January 28, marks the European Data Protection Day, a reference date to highlight the importance of user privacy and data protection.
In our field of safety at work and the management of documentation necessary for the management of prevention in companies, the first step is to analyze what type of personal data is part of the material used by prevention technicians,, whether from their own services or those of others, and that they may manage to carry out their tasks.
These documents can be:
- Health surveillance and medical records, in case of assuming health surveillance.
- Social security labor documents for registration or contributions of workers.
- Clinical history of the worker, in case of assuming the specialty of occupational medicine.
- Training titles.
- Accident investigation.
- Risk assessments, sensitive workers, pregnant women.
- TTE prevention documentation (provision contract, aptitude or training certificates).
For smaller organizations and with low complexity treatments, the analysis will be the result of a reflection, minimally documented, on the implications of the treatments on the rights and freedoms of the interested parties. However, for large organizations the analysis must be carried out using one of the existing risk analysis methodologies given their greater complexity.
All those responsible in each case must carry out a risk assessment of the treatments they carry out, in order to be able to establish what measures they should apply and how they should do it, always seeking expert advice and relying on the official information available from the Spanish Data Protection Agency.
