Prevention in the reopening of hospitality and restaurant activities
The Official State Gazette has published Order SND/388/2020 of May 3, which establishes the conditions for the opening to the public of certain businesses and services, the opening of files, as well as for the practice of professional sports and federated.
All establishments and retail commercial premises and professional services activities whose activity had been suspended after the declaration of the state of alarm may proceed to reopen to the public by virtue of the provisions of article 10.1 of Royal Decree 463/2020 of March 14, by which the state of alarm is declared, with the exception of those that have an area of more than 400 square meters, as well as those that have the character of a shopping center or park, or that are located within them without direct and independent access from the outside.
The second chapter of the ministerial order details the conditions under which hospitality and catering activities must be carried out in_which may be carried out through home delivery services and by collecting orders by customers in the corresponding establishments, with consumption being prohibited inside the establishments. establishments.
In home delivery services, a preferential delivery system may be established for people over 65 years of age, dependent people or other groups more vulnerable to infection. While, in the pick-up services at the establishment, the customer must place the order by phone or online and the establishment will set a pick-up time, avoiding crowds in the vicinity of the establishment. Likewise, the premises must have a space enabled and marked for the collection of orders where the exchange and payment will be made.
In any case, proper physical separation must be guaranteed or, when this is not possible, with the installation of counters or screens. However, in those establishments that have order request and collection points for vehicles, the customer may place orders from their vehicle in the establishment itself and proceed to collect them later.Establishments may only remain open to the public during order collection hours.
The risk prevention measures for the personnel who provide services in hospitality and restaurant establishments included in the standard are:
- The following workers will not be able to take up their jobs in commercial establishments:
- Workers who at the time of the reopening of the commercial establishment are in home isolation due to having a diagnosis of COVID-19 or have any of the symptoms compatible with the disease.
- Workers who, without symptoms, are in a home quarantine period due to having had contact with a person with symptoms or diagnosed.
- The owner of the economic activity carried out in the establishment or premises must comply, in all cases, with the risk prevention obligations established in current legislation, either in general and specifically to prevent contagion.
- It will ensure that all workers have personal protective equipment appropriate to the level of risk, consisting of at least masks, and that they have at their disposal permanently in the workplace hydroalcoholic gels with virucidal activity authorized and registered by the Ministry of Health and/or soaps for cleaning hands.
- In establishments where personalized attention to more than one client at the same time is possible, the interpersonal safety distance of two meters between clients must be clearly indicated, with marks on the floor, or through the use of beacons, posters and signage.
- Customer service cannot be provided simultaneously to several people by the same worker and in the event that more than one client cannot be served individually at the same time, access to the establishment will be carried out individually, not allowing more than one person to stay there, except in those cases in which it is an adult accompanied by a person with a disability, minor or elderly.
