Published the new Collective Agreement of External Prevention Services

The Official State Gazette has published the Resolution of August 3, 2023, of the General Directorate of Labor, by which the III National Collective Agreement for third-party prevention services is registered and published, which will be valid until December 31 of next year.

This agreement will be applicable to companies that meet the following two requirements:

  • That they are accredited as Third Party Prevention Services in the terms set out in article 31 of Law 31/1995, on the Prevention of Occupational Risks and Development Regulations.
  • That they provide services as such by virtue of the subscription of agreements for the development of this activity that regulates article 20 of the Regulation of Occupational Risk Prevention Services, approved by Royal Decree 39/1997.

In companies in which other activities are carried out, in addition to those described in the previous section, this agreement will be applicable only in relation to people who predominantly develop activities and/or functions of the external prevention service.

As a consequence of the above, training, advisory and consultancy activities not related to those provided for in article 31 of Law 31/1995 or the object of the agreement regulated in article 20 of Regulation 39/1997 are not included in the scope of application of this collective agreement. Activities related to preventive auditing are also excluded from the application of this agreement.
