Technical criteria on actions of the Labor Inspection in psychosocial risks

The Labor and Social Security Inspection has just published Technical Criterion 104/2021 on actions of the Labor Inspection regarding psychosocial risks.

Using this technical criterion, the content of the "Guide to assess the quality of risk assessments and prevention management with respect to the prevention of psychosocial risks" and the principles of the Committee of Senior Inspection Officers are adapted with the aim of improving and updating its content and achieving homogeneity in the application of current regulations on this matter in all member states of the European Union.

The document maintains the validity of Technical Criterion 69/2009 on Harassment and Violence at work, taking into account that we still do not have jurisprudence from the Supreme Court that defines moral or psychological harassment and the sentences of other jurisdictional bodies have not yet outlined a unified concept of this conduct.

The new criterion is structured around three major issues:

• The first refers to the control actions for the preventive management of psychosocial risks.
• The second deals with the inspection actions motivated by complaints from workers.
• The third refers to actions regarding health damage and work accidents caused by said exposure.
