The Statutes of the State Prevention Foundation are approved
It has been published in the Official State Gazette this weekRoyal Decree 272/2024, of March 19, which approves the Statutes of the State Foundation for the Prevention of Occupational Risks.
The State Foundation for the Prevention of Occupational Risks, F.S.P., is a foundation of the state public sector that was created by the fifth additional provision of Law 31/1995, of November 8, on the Prevention of Occupational Risks.
The main novelty of the text that is now presented, apart from some small technical modifications, is the incorporation of chapter IV on subsidy management with three articles.
A subsidy commission is created as the body in charge of calling for and granting subsidies, made up only of those employers who cannot be beneficiaries of said subsidies. Likewise, the procedure for calling for and granting subsidies is regulated and establishes, on the one hand, that the Management Directorate of the Foundation will carry out prior control of the content and suitability of the proposed actions and, on the other, that the control functions that involve the exercise of administrative powers will be exercised by the administrative bodies that finance the corresponding subsidy in a greater proportion.
