The Traffic Law, circulation of motor vehicles and Road Safety is modified
The Official State Gazette published last December Law 18/2021, of December 20, which modifies the consolidated text of the Law on Traffic, Motor Vehicle Circulation and Road Safety, approved by Royal Legislative Decree 6/2015, of October 30, on the matter of the permit and driving license for points.
The main new features contained in the standard are:
- Distractions: increases from 3 to 6 the points to be deducted for using, holding mobile phone devices while driving.
- Seat belt and protective elements: increase from 3 to 4 the points to be deducted for not using, or not using it properly, the seat belt, child restraint system, helmet and other mandatory protective elements. The same penalty of 200 euros is maintained.
- Cyclist safety: se increases the safety of cyclists by making it mandatory, on roads with more than one lane in each direction, to change lanes when overtaking cyclists or mopeds. It is also prohibited to stop or park in bike lanes or on bicycle lanes.
- Recovery of license points: 2 years without committing violations is the period that must pass for a driver to recover his initial balance of points.
- Safe and efficient driving courses: 2 points can be recovered from the license for completing safe and efficient driving courses.
- Minors, alcohol and drugs: underage drivers of any vehicle (mopeds, AM permit, motorcycles up to 125cc, bicycles and personal mobility vehicles) will not be able to circulate with an alcohol level greater than 0, both in blood and exhaled air.
- Overtaking: eliminates the possibility that passenger cars and motorcycles may exceed the speed limits on conventional roads by 20 km/h when overtaking other vehicles.
- Anti-start alcohol tester: mandatory for road passenger transport vehicles that are registered from July 6, 2022.
All these new developments will come into force three months after the publication of the standard in the Official State Gazette.
