The responsibility derived from the work accident, the focus of a day in Cádiz with Cuatrecasas
"Responsibilities arising from a work accident" was the name of the conference organized by the Provincial Directorate of Fraternidad-Muprespa in Cádiz and held last Wednesday, the 13th in collaboration with the law firm Cuatrecasas.
Miguel Ysasi, sayProvincial rector of the Mutua was in charge of starting the day, moderated by Barbara Gomez, Technical advisor of Fraternidad-Muprespa Algeciras.
They acted as speakers Juan Manuel Casal, cadvisor-attorney of Cuatrecasas and Associate Professor of the Pablo de Olavide University, and Alfonso Choza, associate attorney of Cuatrecasas Penal Area.
The session delved into the details of the responsibilities mentioned in the title of the session, basically the administrative sanction, surcharge of benefits derived from the accident, civil and criminal compensation, which also sometimes overlap.
Casal specified that the Labor Inspection is responsible for officially investigating workplace accidents, and will do so ex officio when the accident is serious or very serious, when it affects more than four workers, and fatal accidents.
He also explained that the result of the inspection action of the investigation must be the preparation of a report, the requirement regarding the prevention of occupational risks, the stoppage of work in the event of a serious and imminent risk, the proposal for a benefit surcharge, the promotion of procedures regarding Social Security and employment and the infraction report.
For his part, Alfonso Choza explained that liability for a workplace accident has a civil contingency, parallel to the sanction that may be imposed on the employer, and a criminal contingency.
Civil compensation is established to compensate for physical damages, moral damages, property losses or loss of quality of life.
Finally, the speakers responded to several questions raised by the participants in a question-and-answer session, after which the moderator closed the event.
