The employment relationship after the IP declaration, the focus of a day in Guadalajara

“The employment relationship after the declaration of a permanent disability: termination or necessary adjustment?” was the title of the conference held this Tuesday at the Guadalajara New Business Center, a meeting organized by CEOE-CEPYME Guadalajara, in collaboration with Fraternidad-Muprespa, and which also included the participation of Quirónprevención. About 150 attendees, including businessmen, consulting and management professionals and HR managers, attended the event. 

Ana Lorenzo, coordinator ofhe Department of Economic Benefits of Fraternidad-Muprespa, was the first speaker and addressed the origin and legal background of the modifications introduced by the  Law 2/2025, of April 9, a rule that eliminates in the Workers' Statute the possibility of automatic termination of the employment contract after the declaration of a permanent total, absolute or great disability.  

Lorenzo detailed the obligations, when this assumption occurs, of the parties involved: mutual insurance, workers, companies, prevention services and the National Social Security Institute and explained various practical issues linked to these processes.

Maria Elisa Perez, territorial medical director of Quirónprevención explained, for her part, the legislative developments of said law, focusing on the actions of the occupational risk prevention service. 

Other aspects of interest were also discussed, such as the difference between disability and disability, the  job reservation, the  termination of contract, the  settings in the position and the communication and notification periods between worker and company related to the continuity or modification of the employment relationship.

The day was presented by the Secretary General of  CEOE-CEPYME Guadalajara,  Javier Arriola; the deputy of Projects, Provincial Plans and Technical Cooperation of the  Guadalajara Provincial CouncilRaul de la Fuente, and the provincial director of  Fraternidad-Muprespa in  GuadalajaraAlberto Garcia.

Arriola emphasized the need to face these types of situations with training and information to know the steps to follow in procedures that may be delicate.

For his part, García highlighted the work of the Collaborating Mutual Insurance Companies with Social Security in the management of people and health care in the workplace, in addition to defending coordination between administrations, companies and mutual insurance companies to reduce accident rates. Finally, De la Fuente conveyed the commitment of the  Guadalajara Provincial Council with quality employment and the prevention of occupational risks.
