Fraternidad Muprespa analyzes IT and Law 2/2025 in a conference in Huércal Overa

Fraternidad-Muprespa organized last Wednesday the information day "Management of Temporary Disability by the INSS and Law 2/2025 on termination of the employment contract due to Permanent Disability of workers". The event, held in collaboration with the INSS and the Huércal-Overa City Council, was held in the emblematic Plenary Hall of the City Council and had fifty attendees.

Rocio Parra, Councilor for Employment Promotion, representing the mayor, Domingo Fernández, welcomed the event and highlighted the council's commitment to collaboration with entities such as Fraternidad-Muprespa and the INSS and its support to celebrate this type of events. 

He then took the floor Angel Iglesias, director of the Fraternidad-Muprespa Delegation in Pulpí, who emphasized the importance of events like this for both consultancies and mutual companies.

Matilde Góngora, Provincial Director of the Mutua in Almería made the presentation of the speaker,Rosa Maria Serrano, Provincial Director of the INSS, who analyzed in detail the elements to take into account in relation to the control and monitoring of the IT benefit. 

In the first block, he outlined the Legal Regime of Temporary Disability, describing examples of situations in which this type of disability occurs, as well as the minimum requirements to receive a benefit and its duration, also reviewing the powers of the organizations involved in this process and explaining the management of IT after 365 days of sick leave, as well as the termination of the benefit. 

He also explained what happens when there are delays in the qualification of the contingency, different procedures for disagreement with the medical discharge or what the review procedures for medical discharges are like. This first part of the presentation ended by highlighting the importance of the continued collaboration between INSS and Mutua in the Clinical Viewer. 

In a second block, it developed Law 2/2025, which eliminates the automatic termination of the employment contract when a person is declared permanently disabled. Serrano commented on two fundamental aspects. The obligation to adapt the job or relocate the worker to another compatible vacant position. 

This second block was followed by a round of questions and answers with active participation by the attendees and gave way to the closing of the day by Matilde Góngora.
