THE PREVENTION OF OCCUPATIONAL RISKS IN THE COMPLEX COMPANY

The PRL and the current complex business organization of economic activities.

In recent years there have been very significant changes in the form of business organization of productive activities.

Probably the two most relevant and evident changes are those related to the location of the company and the vertical disintegration and outsourcing of processes to other companies with respect to the previous vertically integrated production in a single company, and even in a single plant.

As always, it must be noted that both phenomena are not totally new, nor do they cover the entire business fabric. As always, very diverse forms of production and organization coexist in national and global economies. What is significant is the growing trend of these "new" forms of business organization, their publicity, the importance of the sectors and companies involved and the economic, legal and social repercussions.

There are exogenous factors, and not only factors internal to the company, that drive this trend: the flexibility and relative low cost of some technologies, the development and lowering of prices for some users of infrastructure and the costs of transport and communications, the outsourcing of activities in the primary and industrial sectors, the territorial organization of activities, territorial policies and the interest and competitive advantages in costs.

Although localization/delocalization and disintegration are, in some cases, jointly part of a strategy, in this issue of the La Mutua Magazine We are going to focus on the second. The terms that have been applied to this phenomenon are diverse: organization of the company in the postindustrial model, the diffuse factory, network company, etc. Through outsourcing of activities, process reengineering, nested production, etc. And, as frequently happens, the use of Anglo-Saxon terms proliferates in our country.

From the Law, the core object of the commercial company, the activity itself, is brought into discussion. The consequences in Labor Law, Social Security and Occupational Risk Prevention are also evident. The modification and extension of Article 24 of Law 31/1995 and the recent Law 32/2006 regulating subcontracting in the Construction Sector, show the difficulties of the Right to occupational health to regulate the new conditions.

Contrasting the analysis with business practice, when addressing these issues, we think can be fruitful and to do so we have the opportunity to have the contributions of professionals with proven experience, from well-known companies, on whom this complex task falls.
