SUMMARY CONSOLIDATED TEXT OF THE GENERAL LAW OF SOCIAL SECURITY

In the BOE of October 31, 2015, the Royal Legislative Decree 8/2015, of October 30, by which the new consolidated text of the General Social Security Law has been approved, repealing the previous consolidated text (Royal Legislative Decree 1/1994, of June 20) which has been valid for just over 20 years.

The entry into force occurred on January 2, 2016, with the following exceptions:

• The maternity supplement for demographic contribution to Social Security (regulated in article 60) that applies, from January 1, 2016, with respect to pensions accrued from said date when the circumstances and requirements regulated in the article meet.
• The sustainability factor of retirement pensions (regulated in art. 211), which will apply only to pensions of the same modality that are accrued as of January 1, 2019.

The legal regime of the Mutual Collaborators with Social Security has been included in the new Law in its Title I, Chapter VI, section 2, articles 80 to 101.

Among the most significant novelties of the new consolidated text, the following stand out:

• Within Title I, a specific Chapter VIII is incorporated, dedicated to the regulation of procedures and notifications regarding Social Security.
• In the regulation of the General Regime Title II, two Chapters are incorporated differentiated to regulate, in one, the particularities applicable to part-time workers and workers hired for training and apprenticeships, and, in the other, the specificities applicable to employed workers in the special agricultural systems and domestic employees.
• The new text incorporates, Title IV, the regulation of the Special Regime for Self-Employed or Self-Employed Workers (RETA), while also incorporating the regulation of the special systems for agricultural employed workers and domestic employees.
• A specific Title VI is created, to jointly regulate all non-contributory benefits.
