This is the extraordinary benefit for cessation of activity of self-employed workers affected by fires this summer

Royal Decree-Law 20/2026, of July 29, has launched a package of urgent labor and social protection measures to assist workers affected by the recent fires. Among them stands out the extraordinary benefit for cessation of activity, aimed at those who are self-employed and have seen their activity totally or partially interrupted as a direct consequence of these events. The main novelty is that this benefit, of an exceptional nature,does not require a waiting period and your enjoyment will not be counted as time consumed for future requests for ordinary cessation of activity.

Self-employed workers who have cessation of activity coverage will be able to access it, if they have totally or partially ceased to do so, whether temporarily or permanently. It includes those who pay reduced fees, as provided for in article 38 ter of Law 20/2007, of July 11, on the Statute of Self-Employed Work. 

In cases of permanent termination, once this extraordinary period has expired, the worker may request the ordinary benefit provided for in the General Social Security Law, provided that he or she meets the required requirements.

The rule establishes that the worker must be affected by forest fires that have motivated civil protection measures such as evacuations, access restrictions or confinements. Currently, the benefit is limited to populations included in the official list of affected areas, available in this link.

The benefit will be recognized on a provisional basis from July 22, 2026 or from the date on which the cessation of activity occurred and its maximum duration will be four months.

"This extraordinary benefit is essential to guarantee that no self-employed person affected by the forest fires is left unprotected. In such a complex time, has declared Carmen Rueda, Managing Director of the Mutual Fund, which also emphasizes that“Our objective is clear: to meet the real needs of working people and help them resume their activity with the greatest guarantees, collaborating with their professional offices.”

It will not be necessary to prove the impossibility of carrying out the activity, although the Mutual Fund may request such documentation from January 1, 2027.

Regarding the economic amount It will be calculated by applying 70% of the average of the contribution bases of the last 12 continuous months prior to termination. In cases of partial temporary suspension due to force majeure, the amount will be 50% of the regulatory base.

While the situation of cessation of activity lasts,Fraternidad‑Muprespa will assume 100% of the contribution of the self-employed worker, except for the legally provided exceptions.

The benefit will be terminated due to exhaustion of the maximum period, due to compliance with retirement requirements in permanent terminations or due to the death of the beneficiary.
