Information on financial benefits for caring for minors affected by cancer or another serious illness
Requirements for access to the benefit
- Both parents, adopters or foster parents must be working and in a status of registration in some public Social Security scheme.
In case of annulment, separation, divorce or termination of the de facto couple, as well as when the condition of victim of gender violence is proven, the right to the benefit may be recognized to the parent who lives with the sick person, even if the other does not work, as long as the rest are met of the required requirements.
- The applicant worker must reduce his or her working hours by a minimum of 50% and a maximum of 99.99%.
- The person responsible for the benefit must be in the following situation:
- Credit been diagnosed with cancer or a serious illness included in Annex I of Royal Decree 1148/2011, of July 29, for the application and development, in the Social Security system, of the financial benefit for the care of minors affected by cancer or another serious illness.
- That said serious illness requires a long-term hospital admission that involves your direct, continuous and permanent care .
- Be under 18 years of age. However, after reaching the age of 18, the benefit may be recognized until the deceased turns 23 in the event of suffering from cancer or a serious illness diagnosed before reaching the age of majority.
- Prove the following minimum contribution periods for the person requesting the benefit:
- If you are under 21 years old : no minimum contribution period will be required.
- Those 21 years of age and under 26 years of age : 90 days of contributions in the 7 years immediately prior to requesting the benefit, or 180 days throughout their working life.
- 26 years or older : 180 days, within the immediately preceding 7 years, or 360 days in the total of your working life.
- Be up to date with the payment of Social Security contributions.
Causes of suspension
- When any of the following situations occur in the person receiving the benefit:
- Medical leave (temporary disability).
- Birth and child care leave.
- Risk benefit during pregnancy and risk during breastfeeding.
- Suspension of the employment relationship (ERE, strike, lockout...).
- Alternation in the receipt of the subsidy with the other parent of the deceased.
- Failure to present the medical declaration from the Public Health Service, necessary to extend the benefit, indicating that the need for care of the minor persists.
Causes of extinction
- Due to the death of the person receiving the benefit.
- Return to work or full resumption of work activity of the beneficiary, ending the reduction in working hours.
- Termination of one of the parents in their work activity.
- The need for direct, continuous and permanent care of the deceased does not subsist.
- Once the deceased is 23 years old (26 years old if he or she proves a disability equal to or greater than 65%).
- Due to the death of the deceased.
- Termination of coverage with Fraternidad-Muprespa.
