Death benefit
What is it?
In those cases in which the work accident or occupational disease ends with the death of the worker, Fraternidad-Muprespa will be granted a financial benefit to cover the lack of income in the family unit.
Beneficiaries of the benefit
- The spouse, the de facto partner, the ex-spouse who is divorced, separated or whose marriage was declared void, beneficiaries of the widow's pension.
- Orphans, beneficiaries of the orphan's pension.
- The father and/or mother who are in charge of the deceased, provided that there are no other relatives with the right to a pension for death and survival, nor were they themselves entitled to it on the occasion of the death of the deceased.
Amount and duration of compensation
Spouse, de facto partner or ex-spouse who is divorced, separated or with marriage annulment:
- Six monthly payments of the regulatory base of the widow's pension.
- In the event that more than one beneficiary is present, the distribution of the compensation will be carried out in the same way as the widow's pension, including the guarantee of 40% of the compensation in favor of the surviving spouse or the person who, without being a survivor, lived with the deceased and was a beneficiary of the widow's pension.
- If it is a single beneficiary with a marriage declared void, the amount of compensation will be proportional to the time lived in marriage with the deceased.
Orphan:
- A monthly payment of the regulatory base of the orphan's pension.
- Additionally, the amount resulting from distributing the six monthly payments of the pension's regulatory base among the orphans, if there is no spouse, de facto partner or ex-spouse entitled to compensation. (As of June 22, 2006, it is understood that this condition that there is no spouse exists in those cases in which there was no marriage between the parents of the orphan.)
Mother and/or father:
- Nine monthly payments of the regulatory base, if it is an ascendant.
- Twelve monthly payments of the regulatory base, if it is for both ascendants.
As an exception, in cases of death of pensioners due to permanent disability derived from professional contingencies, the calculation of the compensation will be carried out on the amount of the pension that the deceased was receiving at the time of death.
How is it processed?
Survival benefits and death aid
If you apply for both benefits, you can only use the survivor benefits form. In any case, you must print a single copy and present it to the Fraternidad-Muprespa center closest to your home.
Certificate of salaries for professional contingencies (CPS)
Form that the company must complete in quadruplicate for the determination of the regulatory basis of the death and survival benefit ( IMS ) in case of work-related accident or occupational disease and send two copies to the Mutua, one to the worker or to their family members and keep the fourth.
Personal Income Tax Withholdings on employment income
Form 145 is the form through which people required to submit the income tax return inform their payer of their personal or family data or notify any possible variations they may have suffered.
