Fraternidad-Muprespa participates in a conference on corporate responsibility in work accidents
Fraternidad-Muprespa participated this Tuesday in a work day on “Business responsibility in the event of a work accident.” The Mutua organized the event together with the Illustrious College of Social Graduates of Álava, in whose facilities the event took place.
Susana Jodrá, president of the College of Social Graduates of Álava, was in charge of welcoming and opening the day. Subsequently Jesús Mas, deputy director of the Mutua's legal advice and services center, developed the presentation, explaining the different responsibilities that an employer may incur in the event of a work accident. This is administrative responsibility (violating safety and hygiene regulations entails the application of the administrative sanctions provided for in the Law on Infringements and Sanctions of the Social Order); criminal liability (the Penal Code establishes as a crime the employer's failure to provide the necessary means to workers to carry out their activity with adequate safety and hygiene measures, putting their life, health or physical integrity at serious risk), civil liability (when as a consequence of the lack of safety measures a work accident occurs, the worker will have the right to claim compensation from the employer for the damages caused to him) and surcharge of benefits (Social Security legislation provides that when, as a consequence of a lack of measures safety, a work accident occurs that results in the recognition of benefits, the beneficiaries will have the right to an increase of between 30 and 50% of them, at the expense of the company)
In conclusion and to avoid the legal consequences that a work accident may cause, the employer must comply with and enforce the Occupational Risk Prevention law. Jose Ignacio Diaz, Territorial Director of the northern zone of Fraternidad-Muprespa closed the day.
