'Encounters with the Mutual' analyzes the IT of more than 365 or 545 days
The expert voice of the speaker, Ana Lorenzo, coordinator of the Department of Economic Benefits of Fraternidad-Muprespa and the great interest aroused by the topic resulted in around a thousand people attending the meeting.
Lorenzo opened the meeting by reminding that “ the correct management of IT in its long phases not only avoids administrative incidents, but also guarantees legal security for all parties ”, an idea that marked the common thread of the entire exhibition.
Throughout the session, the complex regulatory framework that regulates these processes was reviewed, from Royal Legislative Decree 8/2015 to the modifications introduced by Royal Decree-Law 2/2023, highlighting that this last reform has led to relevant changes in the delegated payment and in the prolongation of economic effects, which is why, as the author pointed out, “ It is essential that companies update their internal procedures ”.
The webinar delved into the different scenarios that open from day 365 of a medical leave, at which time control passes to the National Social Security Institute, without changing the nature of the process. “ Day 366 is a critical point: the control body changes, but not the nature of the process , ”said Lorenzo, adding that in the interval between 365 and 545 days an extension of the IT is entered into in which the worker continues to be registered and contribute.
After 545 days, the extension of economic effects in direct payment by the mutual insurance company begins, with the obligation of the INSS to qualify the permanent disability within a maximum period of 90 days. Among the examples presented, the highlight was that of a worker who, after exceeding 545 days, continues under medical follow-up without definitive consequences, a situation in which the mutual insurance company maintains direct payment until reliable notification of the INSS resolution.
Another block of the webinar focused on the INSS communication systems with workers, companies and mutual societies, from SMS and electronic notifications to the FIE and FIER files that are sent through the RED System.
Lorenzo recalled that the INSS communicates IT processes to companies no later than the business day after receiving the medical report, and reviewed the business obligations in the submission of economic data, within a period of three business days.
Regarding the importance of tools such as INCAWEB, which requires recording key information such as the job position, the job description or the National Occupation Code, Lorenzo stressed that “ an accurate description of the position and functions is key to the permanent disability assessment processes ”.
To close, the actions that the company, worker and mutual insurance company must undertake when the INSS notifies a resolution were analyzed, both in cases without consequences and in those in which a permanent disability is declared. The author concluded with a message that summarized the spirit of the meeting: " the management of prolonged IT requires rigor, coordination and sensitivity. Behind each file there is a person who needs security and support ".
