Processing the risk benefit during breastfeeding (as an employee)
Before applying for risk benefit during breastfeeding, all possibilities must have been exhausted to ensure that the woman who is breastfeeding her baby can continue working without being exposed to risks to her health or that of her baby, which is why the processing of this benefit is carried out in different phases:
1. Adaptation of the job.
When the woman who is breastfeeding her baby considers that in her workplace there are agents, procedures or working conditions that may negatively influence her health or that of her baby, she must inform her company since it has the obligation to try to adapt her workplace to her new situation to avoid said risks.
- If the adaptations to the workplace eliminated the health risks of the woman who is breastfeeding her baby and her baby, there would be no need to continue with the procedure.
- If it is not possible to make adaptations to the workplace that make the work compatible with the breastfeeding situation, guaranteeing the health of the worker and her baby, the next phase must be continued.
- If measures were adopted to adapt the workplace that made the work compatible with the breastfeeding situation, but these measures are currently no longer sufficient to guarantee the health of the woman or her baby and it is not possible to make new adaptations to the workplace, you must also continue with the next phase .
The Mutual Fund does not intervene in this phase of job adaptation.
2. Medical certification of the existence of risk for breastfeeding in the workplace.
Once the company has tried to adapt the workplace and, despite this, it is still considered that there are still risks to the health of the woman or her baby, while she is breastfeeding, the Mutual Fund must be requested to certify these extremes.
For the mutual insurance company to issue the medical certificate of risk during breastfeeding due to the conditions of the workplace, the woman must present the following documentation:
- Photocopy of the DNI (both sides).
- Request to the Mutual Fund for a medical certificate of risk during breast-feeding.
- Medical report from the Public Health Service that certifies the breastfeeding situation and the absence of complications inherent to the woman's own situation.
- Family book or birth certificate of the baby.
- Company statement regarding risks in the workplace.
Once the documentation has been received, the mutual insurance company will evaluate whether or not it is appropriate to certify the existence of occupational risks during breastfeeding, and the following situations may arise:
- The risks to which the woman who is breastfeeding her baby is exposed, after the adaptations to the workplace, are already likely to pose risks to her health or that of her baby. The Mutual Fund will issue a certificate of existence of risk and the next phase would continue.
- The risks to which the woman who is breastfeeding her baby through breastfeeding is exposed, after the adaptations to the workplace, are not likely at that moment to pose risks to her health or that of her baby; but they could become so in the future. The Mutual Fund will issue a conditional certificate of risk existence , indicating the date from which the evaluated risks could already pose a risk to your health or that of your baby. Upon arrival of this date (*) the next phase would continue.
(*) The certificate issued by the Mutual Fund will only be valid if the indicated date arrives. In this case, the woman would not have suffered any changes in the tasks she performed, nor in the risks to which she was exposed, nor would there have been any complications inherent to her condition, nor would she have interrupted breastfeeding. If any of these situations have changed, you must request a new medical certification again, providing updated information (which the Mutual Fund must reassess).
- The risks to which the woman who is breastfeeding her baby through breastfeeding is exposed, after the adaptations to the workplace, are not likely to pose risks to her health or that of her baby. The Mutual Fund will issue a negative certificate and the process would be completed here.
- That the woman who is breastfeeding her baby is in a situation of temporary disability or presents complications inherent to her health (not related to work). The Mutual Fund will issue a negative certificate and the process would be completed here.
3. Change of job to one compatible with the breastfeeding situation
Once the Mutual Fund has certified that the job may pose a risk to the breastfeeding situation, the company must try to transfer the woman to a different job that is compatible with her condition.
- If it were possible to change jobs to a different one that was compatible with the breastfeeding situation, the procedure would be completed here.
- If this change is not possible, to safeguard the health of the woman who is breastfeeding her baby through breastfeeding and that of her baby, the company must suspend her employment contract due to risk during breastfeeding and continue with the next and final phase .
The Mutual Fund does not intervene in this phase of job change.
4. Application for risk benefit during breastfeeding.
Once the company has suspended the employment contract, to avoid putting at risk the health of the woman who is breastfeeding her baby through breast-feeding or that of her baby, the Mutual Fund must be requested to receive risk benefit during breast-feeding.
In order for the mutual insurance company to recognize the risk benefit during breastfeeding, the woman, who is breastfeeding her baby, must present the following documentation:
- Request to the Mutual Fund for risk benefit during breast-feeding.
- Company statement proving the impossibility of changing the woman who is breastfeeding her baby to a job compatible with her condition.
- Company certificate on the listing bases.
- Form 145 of the Tax Agency for the purposes of applying personal income tax withholding.
- In the case of employed workers obliged to pay their own Social Security contributions, they must present a certificate of being up to date with the payment of their contributions.
Once the documentation has been received, if there is no incident in it and the requirements for access to the benefit are verified, the Mutual Fund will proceed to issue a resolution recognizing the benefit and payment will begin on a monthly basis.
